Please read these terms carefully before making a booking through our website, by phone, or in person. By completing a reservation, you confirm that you have read, understood, and accepted all of the following terms.

About the company Hawaii Boat Tours is a tourism company registered in Montenegro, based in Kotor. We provide boat tour and excursion services across the Bay of Kotor. Contact: phone +382 67 166 756, email hawaiiboatours@gmail.com.

Booking and confirmation Bookings can be made via the contact form on our website, by phone, via WhatsApp, or in person at the pier. A reservation is considered confirmed only once you receive written or verbal confirmation from our team. Please provide the exact number of guests, your contact details, and your preferred date when booking. Reservations for minors must be made by a parent or legal guardian.

Prices and payment All prices are quoted in euros (EUR) and apply per boat or per person, depending on the tour type, as specified in each tour description. Payment can be made in cash on the day, by bank card, or by bank transfer. The price includes the services of a licensed skipper, fuel, use of the vessel, and all equipment listed in the tour description. The price does not include food, drinks, museum or church entrance fees, or any other costs not explicitly stated.

Cancellation and refund policy Free cancellation is available up to 48 hours before the scheduled departure — in this case, any deposit paid will be refunded in full. Cancellations made less than 48 hours before departure are subject to a charge of 50% of the total tour price. In the event of a no-show without prior notice, we reserve the right to charge 100% of the total price. If Hawaii Boat Tours cancels a tour due to adverse weather conditions, a technical fault, or insufficient passenger numbers, the guest is entitled to a full refund or a free rebooking to an alternative date of their choice.

Weather conditions and safety The safety of our guests is our absolute priority. The skipper reserves the right to modify the route, shorten the tour, or cancel it entirely based on weather conditions and sea state. Guests will be notified no later than 2 hours before departure, by phone. In cases of force majeure (storms, flooding, natural disasters, etc.), the company bears no liability, and guests will be offered a full refund or an alternative date.

Guest obligations and conduct Guests are required to arrive at the pier at least 15 minutes before the scheduled departure. All instructions from the skipper and crew must be followed at all times, particularly regarding safety. Excessive consumption of alcohol and any behaviour that endangers the safety of other passengers or crew is strictly prohibited. The company reserves the right to refuse boarding or remove from the vessel any person whose conduct endangers safety or disrupts the experience of other guests, without entitlement to a refund. Pregnant women and persons with heart conditions or other health circumstances relevant to sea travel are required to inform us prior to booking.

Liability Hawaii Boat Tours holds all legally required equipment, licences, and insurance necessary for the provision of boat tour services. Our liability is limited to direct damage caused solely as a result of our proven negligence. The company is not liable for the loss or damage of guests' personal belongings on board, nor for damage resulting from failure to follow crew instructions or sea conditions beyond our control. We strongly recommend that guests arrange their own travel insurance.

Photography and privacy Our skippers may, at guests' request, take photographs during the tour, which are shared with guests at no charge. Hawaii Boat Tours may use tour photographs for marketing purposes, exclusively with prior guest consent.

Governing law These terms are interpreted and governed in accordance with the laws of Montenegro. Any disputes arising from a booking or the provision of services shall be subject to the jurisdiction of the court in Kotor.
